I. General information
The seller prides itself on the quality and health of the plants it sends, and prepares each order individually with the utmost care.
However, due to the nature of the goods sold, special rules for returning goods must be applied.
II. Withdrawal from the contract for live plants
The buyer – consumer generally has the right to withdraw from a distance contract within 14 days.
⚠️ However, this right does not apply to live plants.
In accordance with Section 1837(d) of Act No. 89/2012 Coll., the Civil Code, it is not possible to withdraw from a contract for the supply of goods that are subject to rapid deterioration, which includes live plants.
For this reason, live plants cannot be returned or exchanged after delivery, regardless of the reason.
By submitting an order, the buyer acknowledges this fact.
III. Health guarantee upon delivery
The seller guarantees that:
- plants are healthy, vigorous, and carefully packaged when shipped
- the packaging is designed so that the plants can withstand transport in the best possible condition.
The seller is only responsible for the condition of the plants at the time of delivery.
IV. Damage during transport / defective performance
If the buyer receives plants:
- in an obviously damaged condition
- with signs of serious damage caused during transport
is obliged to:
- contact the seller without undue delay, no later than 48 hours after receiving the shipment
- send photographic documentation of the entire package, the contents of the shipment, and details of the damage to the plants
Late complaints or complaints without photographic documentation may not be taken into consideration.
V. Complaints about live plants
For live plants, rights arising from defective performance may be exercised no later than 7 days after receipt of the shipment.
The seller is not liable for deterioration of the plant caused by:
- inappropriate care
- incorrect placement
- climatic conditions
- buyer manipulation
- delay or error on the part of the carrier, if the shipment was not picked up on time
VI. Individual assessment
Even though the law does not allow for the return of live plants, in justified and exceptional cases, the seller may offer:
- partial compensation
- plant replacement
- alternative solution
This option is entirely at the discretion of the seller and does not give rise to any legal claim.
